North Dakota Capital Enacts New Tanning Laws

You can add Bismarck, N.D., to the list of places looking to ramp up the requirements for tanning salons.

In addition to current regulations for indoor tanning, the city passed an ordinance in late November mandating that salons:

  • Always have staff present when customers are tanning.
  • Inform customers of potential risks in tanning.
  • Require that all tanners wear protective eyewear.
  • Ask all tanners to provide identification or parental permission with each visit.
  • Replace lamps and disinfect beds regularly.
  • Track and record each tanner’s use.

All tanning facilities, with the exception of private residences that have tanning equipment, are required to comply with this ordinance. This includes facilities located in condominium-style housing developments, where the tanning equipment is shared among users.

All tanning salons must be in compliance with the ordinance starting Nov. 27. The Environmental Health Division of the  Bismarck Department of Fire and Inspections will begin conducting inspections Jan. 1.  

Additionally, all pre-operational tanning salons will have to pass a preliminary inspection before receiving a permit to operate. Permit fees are applied on a per-bed basis.
