Tan Time Controversy at U. of Missouri Nearing End

A debate about the University of Missouri’s on-campus tanning center – called “The Spa,” which is operated by Tan Time LLC – will reach its conclusion soon, as both the university and the company participated in a hearing last week and submitted final arguments. Within 15 days, the judge will decide whether or not the tanning beds can stay open in the university’s Student Recreation Complex.

The university tried to close and remove the tanning facility in the summer of 2008, but Tan Time took legal action, citing its lease with the university. A judge agreed and filed a temporary injunction until more facts could come out. Therefore, Tan Time has remained open, but the university has continued its effort to try to shut it down.

The tanning company is seeking a combined $190,000 in damages from the university, citing lost profits from a temporary closure in 2008 and the fact that the business will eventually be forced to move to a new location.

Tan Time leases space from the university to operate within the recreation center. The lease expires at the end of 2010, and it appears that the company is seeking only the right to stay in business in that spot through the end of its lease.
