Teeth Whitening Lawsuit; Certification Plaques

We in the indoor tanning world are always looking for a little good news. That came this week in the form of a legislative victory out of New Jersey. James Oliver, CEO of Beach Bum Tanning, informed LookingFit.com that his salons defeated the New Jersey Dental Association in its attempt to block them from selling teeth whitening products. Alleging unfair competition on behalf of its members, the association argued that Beach Bum salons were practicing dentistry without a license. The judge not only disagreed and ruled in favor of the defendant, the association’s ensuing motion to reconsider the case was also denied.

The New Jersey win sets an important precedent for salons nationwide, as various dental groups have begun pursuing legal action in order to prevent tanning professionals from offering the popular ancillary product. Kudos to Oliver for taking on the opposition – and many thanks to him for investing the necessary time and resources to obtain the legal win. Only time will tell how this affects the proceedings in other states – as well as the likelihood of similar cases cropping up. However, with this solid win under our belt, the odds on our side have been strengthened.
