State Issues

New York – Two new anti-tanning bills were introduced in the New York State Assembly last month, bringing the total in that state to four. A9199 proposes an under-16 ban and A9211 would require a parent to be present each time with those under 18. The New York Legislature operates on a two-year cycle and, if not defeated before the end of 2009, each bill will carry over to 2010.

The three other states still in session for 2000 – Massachusetts, Ohio and Pennsylvania – have been quiet.

County Issues

Delaware County, Ind. – At least for now, it appears that the Delaware County Legislature will not enact additional regulations for businesses operating in that county.

Howard County, Md. – On November 10, the County Department of Health passed an under-18 ban in this suburban Baltimore County. It appears that the board overstepped its authority by promulgating regulations without legislative authority. We are investigating several options for challenging the county’s action.

Baltimore County, Md. – The county council held a work session on November 10 on a proposed teen tan ban.

United States Congress – In its December issue, Cosmopolitan magazine reported that next year, Congresswoman Carolyn Maloney (D-NY) will introduce the “Tanning Bed Cancer Control Act.” According to the article, this legislation will “expand FDA’s regulation of tanning beds by limiting the strength of the UV rays emitted by sunlamps and reducing the amount of time an indoor tanner can be exposed.” Rep. Maloney was the sponsor of the Tan Act in the previous Congress.
